Can they foreclose on my house?

So there is a change of events. I came home from work today in a fairly chipper mood. Someone at work gave me baseball tickets for this weekend and I’m one week away from getting my first paycheck at my new job. I’m greeted by a fairly thick envelope in the mail, that is from an attorneys office. I open it to find this attorney represents the bank that holds my mortgage and is looking to foreclose on our house. It states that we’re two months behind. I won’t lie, I haven’t had a check in a month so we withdrew the $4,400 left in my 401k (after loans were repaid) so I could catch up. The money literally was deposited today in my account. It was my full intention to call and do a check over the phone for April’s payment and another (post dated) for the 15th which would bring me current. So yes, I am 1 month behind, but not two.

I called the bank to make the payments and was transfered to the default department. I was told that they could not accept payment on my account because their attorney will not allow it. I asked how I could fix that and she said for me to call my attorney.

So I did and to make matters even worse, it’s a Friday @ 6pm and the attorney is gone. I left him a very heartfelt message on his voicemail, I can only hope and pray that he’ll check it and call us with some reassuring news. I can’t lose my house. I couldn’t do that to my children. I’ll get another job if I need to, but I can’t lose the house.

If my option is to not file bankruptcy to keep my house, I will. I can’t put my children through this.

Damnit! It’s gonna be a rough weekend.
